Spousal privileges at State Capture Inquiry

Former Finance Minister Malusi Gigaba is claiming, in an application to the Zondo Commission of Inquiry,

that his estranged wife’s testimony before the commission, is motivated by a desire to gain an advantage in their divorce proceedings.

He claims there’s a high likelihood that her evidence will be unreliable, fabricated, emotive and maliciously motivated.

So should the fact that they are getting divorced be factored into what she has to say?

Should their estrangement have any bearing on whether or not she testifies publicly?

We spoke to divorce lawyer Kamal Natha.
